Purpose of the Services
SKIN MD Global provides technology-driven, educational, and promotional content related to skincare, dermatology, wellness, and AI-assisted analysis. You acknowledge and agree that:

The Services are not a substitute for professional medical advice, diagnosis, or treatment.
The SKIN MD app and all AI-generated outputs are not medical devices and are not intended for clinical or diagnostic use.
Users should consult a licensed dermatologist or qualified healthcare professional for any skin concerns or medical questions.

Eligibility
You must be at least 18 years old to use any part of the Services, including facial-image uploads, scanning tools, or AI-assisted skin assessments. By using the Services, you represent and warrant that:

You are 18 years of age or older,
You have the legal capacity to enter into these Terms, and
You will not upload, submit, scan, or provide images of any minor, defined as any person
under the age of 18.

Strict Prohibition on Minor Images
You agree that:

You will not upload images of minors for any purpose.
You will not use the Services to analyze, scan, or assess the skin of a minor.
You will not create an account or allow access to any minor.

If we learn that an underage user is using the Services or that an image of a minor has been submitted, SKIN MD Global may immediately:

Delete the account,
Delete associated data, and
Take any other action necessary to comply with law and protect users.

User Responsibilities

You agree that you will NOT:

Use the Services for unlawful, unsafe, fraudulent, or misleading purposes;
Upload lewd, violent, defamatory, or unauthorized images;
Attempt to bypass or interfere with security features;
Use the Services to make medical or diagnostic decisions;
Upload images of anyone other than yourself without their knowledge and express
consent;
Upload or provide images of any individual under age 18.
You alone are responsible for the accuracy and legality of the information and images you provide.

Account Registration
If you create an account, participate in our beta program, or join our waitlist:

You must provide accurate information;
You must maintain the confidentiality of your login credentials;
You must notify us immediately of any unauthorized access.
SKIN MD Global is not responsible for losses resulting from unauthorized use of your account.

Consent to Image Processing & AI Use
By using the Services, you expressly consent to the processing of:

Photographs or videos you upload for analysis,
Skin images or facial imagery,
Non-biometric image attributes used to generate educational content.

Not Biometric Identification
SKIN MD Global LLC:

Does not use facial recognition for identity verification;
Does not identify individuals;
Does not construct biometric identifiers;
Uses images solely to provide non-medical, illustrative skin-related insights.

SKIN MD Global does not collect or store biometric identifiers (such as facial geometry, retina scans, or fingerprints). The images you upload are processed solely for educational, non-medical skin insights and are not used for identity verification, recognition, or biometric classification. We do not create biometric templates and do not use facial recognition technologies. You agree not to upload or submit images that contain sensitive personal data unless you have the legal right and consent to do so.

You acknowledge that image-processing is performed solely for educational, non-medical purposes and that all output may contain inaccuracies.

Intellectual Property Rights
All content; AI outputs, trademarks, software, images, and materials provided through the Services (“SKIN MD Content”) are owned or licensed by SKIN MD Global LLC. and are protected by intellectual-property laws.

You may not:

Copy, modify, reproduce, distribute, or create derivative works;
Sell or commercially exploit SKIN MD Global Content;
Reverse-engineer any part of the Services;
Use our trademarks without written permission.

You are granted only a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes strictly in accordance with these terms of use.

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of SKIN MD Global LLC. or our licensors except as expressly authorized by these Terms.

AI-Generated Content & Accuracy Disclaimer
AI-generated outputs, including skin assessments, illustrations, comparisons, or insights, are illustrative only. You acknowledge that:

AI output may be inaccurate or incomplete;
AI outputs depend on lighting, image quality, and device factors;
AI outputs do not constitute medical advice;
You must not rely solely on these outputs for skincare or health decisions.

We make no warranties regarding the accuracy or reliability of AI output.

Copyright Infringement & DMCA Notice
SKIN MD Global respects the intellectual property rights of others and requires users of the Services to do the same. If you believe that any content available through the Services infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (“DMCA”). Your notice must include:

Identification of the copyrighted work claimed to have been infringed;

The Services may include links to third-party websites, tools, or applications. We do not control and are not responsible for:

Third-party privacy practices;

The Service is controlled, operated and administered by SKIN MD Global LLC. from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Skin MD Global LLC Content accessed through https://skinmdglobal.com/ in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Consumer Rights Notice (U.K. + EU Users)
If you are a resident of the United Kingdom or the European Union:

Nothing in these Terms limits your statutory consumer rights under applicable law,
including rights to receive services that are of satisfactory quality, fit for purpose, and as
described.
You may withdraw from any paid or subscription-based service within 14 days of purchase,
consistent with the U.K. Consumer Contracts Regulations 2013 and the EU Consumer
Rights Directive.
You may pursue consumer dispute resolution through national consumer protection
authorities, alternative dispute resolution (“ADR”) bodies, or other legally recognized
mechanisms available in your country of residence.

Note: The European Online Dispute Resolution (ODR) Platform was discontinued as of 20 July 2025, pursuant to Regulation (EU) 2024/3228. Therefore, it is no longer available for filing disputes. These protections apply in addition to any rights you may hold under local law.

Indemnification
You agree to indemnify, defend and hold harmless Skin MD Global LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Skin MD Global LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Skin MD Global LLC in asserting any available defenses.

Arbitration (U.S. Users Only)
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms of Use, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms of Use or any disputes arising as a result of these Terms of Use, whether directly or indirectly, including Tort claims that are a result of these Terms of Use. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms of Use.

Class Action Waiver
Any arbitration under these Terms of Use will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Skin MD Global LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. SKIN MD GLOBAL LLC MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

SKIN MD GLOBAL LLC MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. SKIN MD GLOBAL LLC HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKIN MD GLOBAL LLC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SKIN MD GLOBAL LLC HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction
Skin MD Global LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Skin MD Global LLC as a result of this agreement or use of the Site. Skin MD Global LLC’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Skin MD Global LLC’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Skin MD Global LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Skin MD Global LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Skin MD Global LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
